Lottery KTM Motohall Dakar Days

The organizer of the competition is KTM MOTOHALL GmbH, KTM Platz 1, 5230 Mattighofen (hereinafter "KTM Motohall"). Further information about KTM Motohall can be found on the following website: www.ktm-motohall.com.

All natural persons over the age of 18 ("Participants") are eligible to participate. Excluded from participation are the managing directors and employees of the organizer, their families and all persons who are in professional contact with this competition.

 By participating in the competition, participants declare their agreement with these conditions of participation.

 Period of the competition: till 7th of December

CONDITIONS OF PARTICIPATION

Participants whose statements are not true will be excluded from participation. Participants who attempt to manipulate the participation process and/or the competition and/or otherwise violate the conditions of participation will also be excluded. Employees of the organizer, the subsidiaries and associated companies of KTM as well as employees of companies participating in the competition and their relatives are excluded from participation in the competition. If the conditions for exclusion are met, prizes may be subsequently disallowed or prizes already paid out or delivered may be reclaimed.

CONDITIONS OF PARTICIPATION

Participants whose statements are not true will be excluded from participation. Participants who attempt to manipulate the entry process and/or the competition and/or otherwise violate the conditions of participation will also be excluded. Employees of the organiser, KTM subsidiaries and affiliates, as well as employees of companies participating in the competition and their relatives are excluded from participation in the competition. If the conditions for exclusion are met, prizes may be subsequently cancelled or prizes

that have already been paid out or delivered may be reclaimed.

ORGANISATION OF THE COMPETITION, PRIZE NOTIFICATION:
To successfully participate in the competition, it is necessary to follow @ktmmotohall on Instagram and like the competition post.

The winners will be selected at random from all those who have successfully entered the competition and will be announced after the competition has ended.

If the above conditions are met, the winner will be notified by direct message via Instagram. The prize will only be awarded if the winners accept the prize notification by replying within two calendar days of KTM Motohall sending the notification.

If the winner does not accept the prize within this period, a new winner will be determined on the basis of the above-mentioned determination criteria.

The prize will be sent to the winner by post or can alternatively be collected from KTM Motohall.

PRIZE:

A Rally Dakar branded glass bottle with original Rally Dakar sand and a KTM Motohall Rally Roadbook originally signed by Heinz Kinigadner, Marc Coma, Cyril Despers, Sam Sunderland and Matthias Walkner.

Cash redemption or exchange of the prizes is not possible. The winner must have communicated their postal address by 31.12.2024 or have collected the prizes from KTM Motohall.

KTM Motohall does not bear the costs or responsibility for any local tax or other consequences in the form of duties in connection with the receipt of a prize from KTM Motohall. Such consequences therefore relate solely to the relationship between the individual and the national tax and duty authorities.

EARLY TERMINATION AND ADJUSTMENT OF THE CONDITIONS OF PARTICIPATION:

KTM Motohall reserves the right to terminate the competition at any time without prior notice or to change the conditions of participation if, for technical or other reasons, the proper conduct of the competition cannot be guaranteed or the fairness of the competition appears to be impaired. This does not give rise to any claims by participants.

PERSONAL RIGHTS FOR FILM AND PHOTO SUBMISSIONS:

The participant agrees that his/her video or photo may be published for the purpose of the competition and may be published by KTM Motohall or a partner commissioned by KTM Motohall for advertising purposes. This authorization includes in particular the publication on the websites and on the Instagram and Facebook profile of KTM Motohall. This consent can be revoked in writing at any time. The revocation applies to all future publications, but not to those already made.

LIABILITY OF KTM MOTOHALL:

KTM Motohall is only liable for intent and gross negligence. This does not apply in the event of negligent breach of a material contractual obligation. These are obligations that enable the competition to be carried out and on the fulfillment of which the participant can therefore rely. In this case, KTM Motohall's liability for slight negligence is limited to typical and foreseeable damage. The limitation of liability does not apply to damages resulting from injury to life, body or health.

USE OF THE DATA:

The personal data of the participants will only be used for the purposes of the competition stated in these conditions of participation. The person responsible within the meaning of the GDPR is the organizer of the competition named in the conditions of participation. By participating in the competition, the participant grants the organizer the non-exclusive, geographically unrestricted right to reproduce the entries on the website and on the organizer's social media platforms without remuneration, even after the end of the competition.

Consent can be revoked at any time by sending an email to privacy@piererindustrie.at.

The revocation only applies to future publications and does not affect the legality of previous publications.The organizer undertakes to process the data received in connection with the competition in compliance with the applicable laws.The processing and disclosure of the data is based on Art. 6 para. 1 lit. b GDPR.

 The organizer is not liable for damages caused by errors, delays and/or interruptions in data transmission, technical errors, incorrect and/or incomplete content or virus-related loss or deletion of data.

 Exclusion from the competition, premature termination, liability: KTM Motohall reserves the right to disqualify participants who manipulate the competition and/or violate the conditions of participation or common decency and/or otherwise abusively attempt to win the competition without notice, or to reclaim their winnings if necessary.

This competition is in no way sponsored, endorsed or administered by or in association with Instagram and Instagram accepts no liability for any element of this competition. KTM Motohall accepts no liability to the winner for any loss or damage of any kind arising out of or in connection with the competition, the data processing and the prize.

The entire competition is subject to Austrian law to the exclusion of the conflict of laws rules.

Should any of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

 Legal recourse is excluded.
