GENERAL TERMS AND CONDITIONS OF KTM MOTOHALL GMBH

(hereinafter referred to as “MOTOHALL”)

SCOPE OF APPLICATION, HOUSE RULES

The scope of application of the General Terms and Conditions of KTM Motohall GmbH (hereinafter referred to as “MOTOHALL”) shall apply exclusively to deliveries or services in connection with the operation of the MOTOHALL museum, all MOTOHALL events, sales in the KTM shop, and the online ticket shop at www.ktm-motohall.com.


By purchasing and possessing an admission ticket, the visitor also accepts the respective currently applicable house rules of the MOTOHALL.


ADMISSION, TICKETS, VALIDITY, AND OPENING HOURS

Visiting the KTM Motohall and the KTM Shop is only possible during their opening hours (see the notice in the entrance area or at www.ktm-motohall.com).


Tickets can be purchased either online at www.ktm-motohall.com or via the ticket sale systems in the KTM Motohall. The contracting party and organizer shall solely be MOTOHALL. SIX Payment Services (Europe) S.A. is not a contracting party/organizer, but acts in the name of and on behalf of MOTOHALL in the technical processing of online ticket sales. Only a valid admission ticket entitles the holder to visit the MOTOHALL. The validity of the ticket depends on the specific information on the ticket. If there is no specific information on the ticket, the ticket is valid on the specific day once for four hours after registration/entry at the turnstile.


MOTOHALL shall have the right to refuse to sell tickets, for a certain period of time or permanently in serious cases, to persons who interfere with the orderly sale of tickets, or other persons, or visitors, or who contravene the respective house rules or the instructions of the cashier.


TICKET PRICES AND PAYMENT

The prices that apply are those published in the respective printed material and on the Internet (www.ktm-motohall.com). Admission prices in EUR include the statutory VAT.


Discounted tickets can only be purchased if there is an entitlement to the discount and this is verified (e.g., photo ID). There is no right to a discount on a ticket or to a specific type of ticket. In the event that an unjustified discount is obtained, the difference between the full price of the ticket and the discount will be reclaimed.


Tickets can be paid for online by credit card (MasterCard, VISA, American Express, Diners Club, and JCB), bank transfer, or PayPal. An online booking is automatically confirmed electronically and delivered by e-mail. Tickets can be purchased at the ticket office or from the vending machines in the MOTOHALL by cash, cash card, or credit card (MasterCard, VISA, American Express, Diners Club, and JCB).


Ticket purchases in all forms are binding. Purchases by credit card are only valid if the purchase price is authorized by the credit card company.


REFUNDS OR COMPENSATION FOR TICKETS AND GUIDED TOURS

Reserved and booked tickets and guided tours can be canceled free of charge up to 14 days before the date of the event. Tickets and guided tours that have already been paid for will not be exchanged and the purchase price will not be reimbursed. Compensation for tickets and guided tours not used or only partially used will not be paid. This applies in particular for cases of non-attendance or late arrival. A delayed arrival of 30 minutes or longer will be regarded as non-attendance. Notwithstanding the above considerations, the statutory provisions shall apply in the event of a withdrawal from the contract.


CONDITIONS FOR PARTICIPATING IN COMPETITIONS AND GUIDED TOURS

Natural persons over the age of 18 are eligible to participate, except for employees of MOTOHALL and their relatives. The right of legal recourse is excluded. The services specified in the competition will be drawn as prizes. The prizes will not be paid out in cash. Participation via competition clubs and automated services is not permitted.

MOTOHALL reserves the right to exclude participants from the competition due to false information, manipulation, or the use of unauthorized aids. Participation in the competition is free of charge. The winners will be randomly selected and notified by e-mail, and may be published by name on the website. If no response is received within 48 hours, a new winner will be drawn. The closing date for entries specified in the competition shall apply.


CONTENT ON THE WEBSITE

The content provided on the MOTOHALL website may only be used for ordinary, private, and non-commercial browsing purposes. Unauthorized changes or any other use of any content constitutes an infringement of copyright and is prohibited. The prior consent of MOTOHALL is required for the reproduction or publication of any of the content and, in particular, for the use of texts, parts of text, or images.


USING SIMULATORS

The user acknowledges that all claims, in particular claims for damages, against KTM Motohall GmbH in connection with the use of driving simulators, are excluded. The above exclusion of liability shall not apply in the event of an intentional or grossly negligent breach of an obligation by KTM Motohall GmbH, in the event of injury to life, body, or health, or in the event of liability under the Product Liability Act. In this regard, it is expressly pointed out that the use of driving simulators is in any event prohibited for persons who have not yet reached the age of 14 and the use of such simulators can cause physical discomfort. The driving simulators may only be used by the maximum number of persons permitted at any given time and the instructions by the employees of KTM Motohall GmbH on the use of the simulators must be followed without exception.


LEGAL DISCLAIMER

The MOTOHALL website was created to the best of our knowledge and thoroughly checked. Nevertheless, we cannot assume any liability that the functions on the website are free of errors, that errors will be corrected, or that the MOTOHALL website or the server are free of viruses or other harmful programs, functions or similar. Access to and the use of the contents of the MOTOHALL website are the sole responsibility of the user.


References to other Internet sites are characteristic elements of the Internet. The content of pages to which reference is made are expressly not part of the MOTOHALL website. Any warranty or liability for any content on such sites is expressly excluded. MOTOHALL expressly distances itself from any illegal content on such sites and is not responsible for the content or functions of such websites. Connecting to such websites is at the user’s own risk.


Visitors to the museum are obliged to adhere strictly to the MOTOHALL house rules. Accordingly, MOTOHALL does not accept any liability for personal injuries or damage to property in the entire museum area (both inside and outside).


DATA PROTECTION

In order to purchase an online ticket, a visitor needs to register on the MOTOHALL website with their personal data (name, address, telephone number, e-mail address, date of birth) and a user profile is then created. MOTOHALL will process the data provided in connection with the performance of the contract and customer service. The customer data will only be passed on to third parties if this is necessary for the performance of the contract. Tickets can only be purchased without disclosing personal data by purchasing them directly at the KTM Motohall ticket office and making immediate cash payment. Further information on data protection can be obtained at www.ktm-motohall.com. All personal data collected will be stored exclusively to provide individual support and the submission of information relating to MOTOHALL. FINAL PROVISIONS

If the legal form of MOTOHALL changes, MOTOHALL in its new legal form shall assume all the rights and obligations of the ticket purchases already made at that time.

These terms and conditions are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is A-5230 Mattighofen. MOTOHALL shall be entitled to change the general terms and conditions.
